These Terms & Conditions (“Terms”) govern your use of availablelightmedia.com and your purchase, access, and use of materials offered by Halo Mountain Enterprises LLC, doing business as The Available Light (“The Available Light,” “we,” “us,” or “our”). By using the website, creating an account, or purchasing or accessing a product, you agree to these Terms.
1. Eligibility and Adult Responsibility
You must be at least 18 years old, or the age of legal majority where you live, to make a purchase or enter into these Terms. The Available Light: Student Edition is designed to be purchased and administered by a parent, guardian, teacher, or other responsible adult. The purchasing adult is responsible for the account, use of the materials, supervision of student activity, and compliance with these Terms.
2. Products and Educational Use
The Available Light provides downloadable and online educational materials. Product descriptions, included files, access methods, and prices are those displayed at the time of purchase. We may correct typographical, technical, pricing, or descriptive errors and may improve or update materials when appropriate.
The Available Light: Student Edition is structured as an approximately 140-hour photography elective. Credit designation, transcript treatment, grading, recordkeeping, legal compliance, and acceptance by a school, district, college, scholarship provider, or other institution remain the responsibility of the parent, guardian, educator, and applicable institution. We do not guarantee academic credit, admission, employment, income, publication, awards, or any particular educational or professional result.
3. Purchases and Payment
Prices are shown in U.S. dollars unless otherwise stated. Payments are processed through Stripe or another payment method made available through WooCommerce. You agree to provide accurate billing and account information and authorize the applicable payment processor to charge the amount shown at checkout, including any applicable taxes or fees.
An order is accepted when payment is successfully processed and access or delivery is confirmed. We may cancel or refund an order affected by a pricing error, suspected fraud, unauthorized payment, technical failure, or violation of these Terms.
4. Digital Delivery and Access
Products are delivered digitally through account access, download links, email, or another method described at checkout. You are responsible for using a compatible device, maintaining internet access, saving downloaded files, and keeping backup copies for your permitted use.
Access is intended to remain available for the period described with the product, but no website or hosting system can be guaranteed to operate without interruption. We may change the technical method of delivery or access while continuing to provide the purchased materials in a reasonably usable form.
5. Household License
A household purchase provides a limited license for one household, including siblings who live in that household.
Subject to these Terms, we grant the purchaser a limited, nonexclusive, nontransferable, revocable license to download, print, and use the purchased materials for personal educational use within one household. The license does not transfer ownership or copyright.
A Household License does not permit use by another household, school, classroom, co-op, club, tutoring business, organization, or commercial program. Those uses require an applicable Classroom & Co-op License or separate written permission from The Available Light.
6. Classroom & Co-op Licenses
A Classroom & Co-op License permits use only by the number of students, and within the group or program, identified by the product purchased. It may not be expanded, transferred, shared between unrelated organizations, or reused for additional groups beyond the purchased scope without written permission or an additional license.
7. Prohibited Uses
You may not:
- Share login credentials or download links outside the licensed household or authorized group.
- Copy, upload, post, email, distribute, sublicense, resell, rent, or otherwise provide the materials to another person or organization except as expressly permitted by the applicable license.
- Publish the materials on a public or private website, file-sharing service, learning-management system, social platform, shared drive, or other repository accessible outside the licensed users.
- Remove copyright, trademark, license, authorship, or other proprietary notices.
- Use the materials to create, market, or sell a competing or substantially similar course, curriculum, publication, or product.
- Attempt to bypass account, payment, download, security, or access controls.
8. Refunds, Returns, and Replacements
Because these products are digital and can be copied once accessed, purchases are final once the materials have been accessed or downloaded, except where a refund is required by law.
You may contact us within 14 days of purchase if:
- You were charged more than once for the same purchase; or
- A verified technical defect prevents you from accessing or using the purchased files and we cannot provide a working replacement or reasonable access solution.
Refunds are not provided for change of mind, failure to use or complete the materials, dissatisfaction with personal results, accidental purchase after access, or device, software, printer, internet, or third-party compatibility issues that do not result from a defect in the supplied files. Nothing in this section limits rights that cannot legally be waived.
9. Account and User Responsibilities
You are responsible for maintaining accurate account information, protecting your password and download links, and promptly notifying us of suspected unauthorized access. You are also responsible for appropriate adult supervision, student safety, lawful access to locations, permissions to photograph people or property, equipment use, travel decisions, and compliance with local rules and laws while completing activities.
10. Intellectual Property
All website content and course materials, including text, exercises, instructions, designs, graphics, templates, downloadable files, logos, and their arrangement, are owned by or licensed to Halo Mountain Enterprises LLC and are protected by copyright, trademark, and other intellectual-property laws. Except for the limited license expressly granted in these Terms, no right, title, or interest is transferred to you.
Students retain ownership of photographs and original work they create. You grant us no rights to student work merely by using the materials. We will request separate permission before publicly using student work, testimonials, names, or identifying information.
11. Third-Party Services and Links
The website may rely on or link to third-party services, including payment, hosting, email, or software providers. We are not responsible for the independent availability, content, security, or practices of third-party services. Your use of those services may be governed by separate terms and privacy policies.
12. Disclaimer of Warranties
To the fullest extent permitted by law, the website and materials are provided “as is” and “as available.” We make no express or implied warranty that the website or materials will be uninterrupted, error-free, suitable for every student, compatible with every device or program, or produce any particular academic, artistic, professional, or financial result.
Educational information is provided for general instructional purposes and is not legal, tax, medical, safety, accreditation, or professional licensing advice.
13. Limitation of Liability
To the fullest extent permitted by law, Halo Mountain Enterprises LLC, The Available Light, and their owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, access, profits, opportunities, or goodwill arising from or related to the website, materials, activities, or these Terms.
To the fullest extent permitted by law, our total liability for any claim arising from or related to a product will not exceed the amount you paid for that product. Some jurisdictions do not allow certain warranty exclusions or liability limitations, so portions of this section may not apply to you.
14. Assumption of Responsibility and Indemnification
You accept responsibility for how the website and materials are used and for decisions made while completing activities. To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Halo Mountain Enterprises LLC, The Available Light, and their owners, officers, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable costs arising from your violation of these Terms, unauthorized use or distribution of the materials, unlawful conduct, or infringement of another person’s rights.
15. Suspension or Termination
We may suspend or terminate access where reasonably necessary to address fraud, payment reversal, security risk, unauthorized sharing, infringement, abuse, or another material violation of these Terms. Termination does not eliminate payment obligations or restrictions that by their nature should continue, including license limits, intellectual-property protections, disclaimers, liability limits, and indemnification obligations.
16. Changes to These Terms
We may revise these Terms to reflect changes to our products, website, business practices, or legal obligations. Updated Terms will be posted on this page with a revised date. Terms in effect at the time of purchase will continue to govern that purchase unless a change is required by law or is necessary to protect the security or integrity of the service.
17. Governing Law
These Terms are governed by the laws of the State of West Virginia, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise. Any dispute will be brought in a court of competent jurisdiction serving the location of Halo Mountain Enterprises LLC, unless applicable law provides another required venue.
18. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the affected provision will be enforced to the greatest extent permitted by law. These Terms, the Privacy Policy, the applicable product description, and any license terms shown at purchase form the entire agreement concerning the website and purchased materials.
